The Utah Indoor Clean Air Act went into effect January 1, 1995. This law was implemented to protect Utahns and their visitors
from harmful exposure to Environmental Tobacco Smoke (ETS).
It bans smoking in most public places, including private businesses.
Of the 4,000 toxins in Second Hand Smoke,
over 200 are poisonous, and 43 cause cancer. It's estimated by the
Environmental Protection Agency (EPA) Second Hand Smoke causes 3,000 lung cancer deaths per year.
In addition, it accounts for 35,000 deaths from heart disease annually.

What are Publicly Accessible Places?
It means any place of business, commerce, banking, financial,
or other service-related activity to which the persons not
employed at the place of public access have regular access.
The law applies whether or not the place is private, non-private,
as well as for-profit or non-profit. For example: |

Restaurants,
fast food establishments, cafes, cafeterias |
|
Buildings:
offices, shops, restrooms, elevators |
|
Taverns
or cabarets |
|
Shopping
malls |
|
Libraries,
theaters, concert halls, museums, art galleries, planetariums,
historical sites, auditoriums, or arenas |
|
Barber
shops, hair salons, laundromats |
|
Sports,
fitness centers, health clubs |
|
Busses,
light rail, taxi cabs |
|
Schools,
colleges |

Who enforces the Law? |
|
|
Building owners, agents, or operators of places where smoking
is prohibited are required to enforce the law by asking persons
to extinguish any lighted tobacco products where smoking is
prohibited. If the person refuses, he/she must be asked to
leave the premises immediately. |

Employers have a duty to assure employees comply with workplace
smoking policies. |
|
|
Tooele County Health Department and the Utah Department of
Health are charged with investigating complaints regarding
violations and for enforcing the Utah Indoor Clean Air Act.
